Question How much spousal support should be in my case? marriage lasted 7 years, i did not let her work as I wanted her?
I live in Edmonton, Alberta, Canada.I make $60000/year. Take home income/month is like $3200. I pay for the car ($407/month),I pay for gas $200, Insurance $85, this car has to be sold and divided equally. I own an apt in Ontario (it is rented out for $900- so total monthly net income $4100. It has to be sold and divided equally) and I pay extra $200 on top of rent for mortgage and mantainance. I pay $400 for interest on the loan which is in my name but was used for family expenses.I pay $825 for my apt rent in Edmonton.I pay $866 for two kids (7 and 2), $96 for child care, $300 for SPOUSAL support. Lawyer fee goes from credit card so I pay minimum payment of cards ($100), I have paid over $5000 to lawyer already. After all expenses $621 is left. I have not included my expenses like eating, cigrets, laundry, etc. My credit card balance is building up day by day. My ex-wife works part time two places, dental office where she makes $20/hr for7 hours 3 days a week (about $1400 as dental assistant after tax/month)(she works intentionally part time here i think) and A&W two days/week where she makes (minimum net$500/month). She probably gets about $700 or more from Gov for universal and ctbt.$1262 form support payments. So according to my calculation her net income is $3862. After all expenses she probably saves $20000/ month. She got financial aid from gov so did not pay much to lawyer. There is no loan on her as I paid all her credit cards when in marriage. NOW, my question to all readers is: Is she entitled to $300 spousal support what judge ordered without looking my expenses. It has been 7 months since we separated. She asking for my share for her computer repair expenses and my lawyer says that I must pay it. And I say WHY? Is she entitled to spousal support ? Should i change lawyer? Is gov support for kids considered income in this case? Please help i am in deep pain. She pays $1200/month including electric, cable tv. May be $40 for cellphone, $35 for laundry, max $500 for grocery because she cooks home, she used to buy a bus card for $60. Medical is provided by my company to all of them. She recently baught a car. These are her details, I did not forced her not to work, she could work in a call center but I supported her to go school and take a dental assistant course. $1200 (is apt rent) Here in canada, child support is according to non custodial parent's salary, here in Alberta for two kids is $866 child support, its like cast on stone. No one can change it, unless i am able to take more than 40% custody and kids start living with me some of time.

Best Answer You neglected to mention how much her rent/mortgage is, How much she spends on food and clothes for her and your children, vehicle expenses. Medical bills (if this applies) utilities, phone, insurance and anything. once you calculate what she has left over i could answer weather she deserves $ 300 dollars from you.

hi, so i heard theres this program where you apply for help with housing, like section eight, but here you apply and if youre eligible, they find you a decent house depending on the size of your family, and you move in and they pay a certain amount of your rent, or mortgage or whatever. im not too familiar with all the details, thats why i was hoping someone might now and share them with me and let me know what the program is called? very much appreciated, any response will be very much appreciated! by the way, i live in vancouver WA. if thats relevant?

Question Vancouverite Moving to Toronto - Where Can I Get A Mortgage Helper?
Hey guys, I am from Vancouver and I will be moving to Toronto next year (2012) around April. I am looking for a mortgage helper, that is, a house where I will be able to rent out the basement suite for extra income. I currently live in the Dunbar area of Vancouver, so a similar neighbourhood in Toronto would be ideal. Price Range is around the 500,000 mark. Also, areas in Toronto that are similar to North Burnaby or Richmond, in terms of diversity, major retailers (COSTCOs, LOBLAWs (Superstore) FutureShop, BestBuy..etc) are also great. Extra Bonus would be that it was close to University of Toronto/Downtown, but this is not necessary. Thanks for any help you can provide!!

Question What do I need to take with me and my family for a 4 month move?
My husband is going to Regina Saskatchewan to train with the RCMP, from Winter to early summer 2009. We have three children so rather then make him or us suffer from lack of contact, I and the girls will be flying there after he goes. He is going to drive the car so I want to pack up as much "stuff" as I can fit in it, so I don't have to buy it all when I get there. I need help with my "list". I have the obvious, clothes, shoes, coats, dishes, soap, towels, snow pants, boots, sheets, etc. but I need help with the little things I might forget. we will be moving into an unfurnished apartment for about 4 months, and I will need everything to keep a house hold of five running for that time. I know I will have to get some furniture there to live but if there are any small household items that I can bring with us would save a lot of $$$, seeing as how I will be paying apartment rent and a mortgage in Ontario. As I said I already have over a hundred things on the list, but I just want to get as much down on the computer as possible to make it less hectic. thanks

Best Answer You can rent your furniture since you will only be there for 4 months. Have each child pick three favorite toys to bring. Keep in mind that anything you take needs to be an item that is necessary, something you know you will use at least once a week. Are you going to all drive back together? If so, where is all the stuff you are packing in the car going to go on your trip back? These are the things you need to consider.

Question mortgage loans after signing separation agreement?
I am a little worried about my wife's mortgage loans plans. We've signed the separation agreement two months ago. Recently My wife plans to buy a house with a big mortgage loans. Does that mortgage loans make a difference on me before we are really divorced in court? If she couldn't pay the mortgage, will it damage my credit? And many thanks! Best Answer You are now legally separated. Any debt she incurs is HER personal debt. Your name will not be on the title to the home or the mortgage. You cannot be held responsible for any financial dealing she makes after the date of the separation. To be sure, have a lawyer review your separation agreement to make sure you are covered.

Best Answer You need an Alberta lawyer, or at least a realtor that knows Alberta property and family law. What really matters is who is on the title to the property. You could see about going down to city hall and checking the title.

We need to chastise them! Complain to the management, in the stores where you shop. Write, call, fax or email their corporate offices. Complain to local, state and national governance. Tell them that they are undermining the unity of our county by promoting the divisive use of a second language. Point out the problems that Canada has with the French speaking province of Quebec. Tell them how unhappy you are that they have chosen to pander to the Hispanic community. A community that is emboldened and supported by ALL the major national Hispanic organizations who's racist agenda includes, incessantly and vehemently: Endorsing and promoting open borders and the massive illegal Hispanic invasion of our country; while constantly and arrogantly promoting bi-lingualism! Those pundits of illegal immigration will keep denying illegals usurping WELFARE because they dont have papers. Outright lie. They dont ask WELFARE for themselves being the illegal parents, but for their anchor babies. They are extended beneficiaries of WIC, Medicaid, soup kitchen etc,. Give them more incentives not to report that they work. When responsible people think of prosperity thru planned parenthood, safe environment for their offspring, college education for their children, illegals procreate (not in the same values we hold apparently for starting a family) because they KNOW for decades that a citizen child is their meal ticket. The government never ask if you're undocumented, only if you are qualified, and having an anchor child qualifies you for anything in California. Why do we get penalized by paying for the illegals crowding our schools and bankrupting the hospitals? Why elected goverment officials keep on trying passing a law giving driver licenses to illegal aliens, when they dont even want to learn the language? Question Notary Advice Quebec Legal Help?
I'll explain my situation in case you might have any advice as to what we can do. My husband and I have sold our condo. We handed over all papers relating to the condo to our agent to give to the buyers notary. The notary called me today and asked where the survey certificate was. I told him this was everything I had received. I then called our notary who had prepared our papers who told me there was none provided so he got us title insurance instead but never told us we needed one. No previous buyers have ever had to produce one when selling and now we are apparently the only ones who are being forced to get one done! The notary told me the cost would be minimum $1000!!! I am livid. He said it was the fault of the notary when we bought the place but we didnt have time to seek legal action against him because we only have two weeks to close. The buyers are getting their mortgage through the royal bank and the bank has asked for the survey certificate. I asked their notary if they can do the same as us and get title insurance but he said it is not enough as legally I have to provide one. It is a condo, and they dont even want the outside to be surveyed, its the inside of the condo?! Any help as to what I can do?! I am already taking a loss with the sale and there will be no equity for us after we pay the agent and break the mortgage. I don't have any more money so any suggestions would greatly help.

Question Legal help needed: "Squatters rights"/adverse possession, or what? PLEASE HELP! We may be homeless soon!?
I have been living in my current house for twelve years (moved in 1998). I live in New Brunswick, in case things vary province to province. My husband (we did not marry until 2003 and are now separated) is the legal owner of the house, which was purchased from the bank, in the sense that only his name (and the name of his deceased grandfather) is on the mortgage. Here, however, lays the problem: In September, 2007, my husband was sleeping with another woman, so we separated and he has been living in another location since that time. Last June, 2009, my current partner moved in and she still lives here. We (my husband and I) have a 17 year old daughter whom he left to live with me, but she went to live with him two months ago as she beat me up badly and I could no longer allow her in the house. During the three years she was staying here, however, my husband paid no form of child support or alimony; he did, however, agree to pay the mortgage and keep my daughter and me on his health plan (which he doesn't have to pay into anyway, but that is besides the point). This April, 2010, my partner and I had to go on social assistance and so my husband told us we need to start paying the mortgage. We asked my husband how much the mortgage was and he told us it cost $550 a month, but after a call to the bank, we discovered it was only $439 monthly. So, for the months of April, May and June, we have been giving him $500 a month. Also, since he moved out in 2007, I have also been paying the water and sewage and well as the electric bills (which are in his name and which he left me with an obscenely high balance owing). Last week we received a letter in the mail from the bank, but did not open the letter as it was under his name. Last night, however, a gentleman from Home Alone services delivered a letter saying it was from the bank advising us to contact them or we would have the locks changed within 24 hours, so we opened the letter from the bank to discover the mortgage had not been paid in over 5 months (3 of those months, my daughter was still living with my current partner and me). My husband was no help, as I called him and asked if the mortgage was being paid and he replied "well it should be, I've been putting the money in the bank", which is obviously a complete lie. I called the bank's accounts receivable department this morning but they refused to discuss the issue with me as my name does not appear on the mortgage and told me I needed to contact a lawyer. I also called the Home Alone company and spoke to a lady who told me not to worry, that she would explain the situation to the bank. We no longer have legal aide in our province, but our case manager gave us a number for anti-poverty legal assistance, which I called this morning and was told all they could do was listen to our case and offer advice (for a $30 fee). I am at a complete loss for ideas and am not sure what actions I can take. I don't know very much about squatters rights/adverse possession, so I was hoping someone would be able to give me some information. I'd like to think I have some right to the house as I am legally still married to this wonderful person (translate: jerk) and I have been living in this house for twelve years now... I just have no idea what those rights may be. I am sorry for the long post, but felt it necessary to provide all the details. Best Answer You really need to find an attorney, this whole situation is to messed up to deal with on your own. First SAVE EVERYTHING, whatever you paid if it was by check keep those carbon copies, bills make records if you have to of what you've done and date those records. And find an attorney ASAP. As far as adverse possession goes in NJ the time limit is really long. "In New Jersey, the duration of such possession is sixty (60) years for uncultivated land and thirty (30) years for other real estate. New Jersey Code §2A-14-30." So I don't think that will help you get the house. If you sue for divorce, the marital property will be split up according to your state's laws, an attorney will be able to explain this. Start calling family law attorneys and ask about hourly rates, or if the firm does any pro bono work. good luck

A good friend of mine fell victim to a sweepstakes scam phone call from Canada. He was promised a six figure win, but to claim it he wired five figure money from his home mortgage line of credit. Now he finds himself upside down on his mortgage. Can he recover any money through legal,legist means? He has notified the police and victims advocate, but they would not help him without a report from the police. He is in despair> He has filed a police report.

Best Answer Why isn't he getting the report from the police? Tell him to go file it ASAP. If he's an american and the company is in Canada, suing is a bit difficult. Poor guy, they saw him coming.

We applied for a line of credit at a bank. The loan was denied and the reason explained. Then we were told the only way we could get a loan was based on equity if we transferred our mortgage. We followed up on the information given and found we were lied to. Who can help us?
